Re: Reassessment of the judiciary

Professors for a Strong Israel is concerned by the repeated intervention of the judiciary in issues that belong naturally to the domain of the executive or the legislative branches, violating the principle of separation of powers that is so necessary to democratic government. Even Minister of Justice Yossi Beilin agrees that when the High Court of Justice frees prisoner held by the defense establishment, prisoners held in order to free our own prisoners and MIA's, the Court has taken on itself the powers of the political echelon.

The Court's most recent decision damages the security of the State by calling into question the assurance it gives to every IDF soldier that if he is captured, the State of Israel will spare no effort to bring about his release. No wonder that the critics of the decision include the Prime Minister and Defense Minister, the Deputy Defense Minister, the Chief of Staff, and the Commander of the Air Force.

A previous decision of the High Court of Justice, concerning residency rights in Katzir, struck at the preference that is rightly given to Jews in the state that was founded for the express purpose of solving the "Jewish question." In these and other decisions the Court has attacked the State's very means of survival, and thus brought damage to its own reputation in the eyes of the public.

Professors for a Strong Israel states that just as Israel must be a Jewish state that is faithful to democracy, she must be a democratic state that is faithful to Judaism and Zionism. The trespass of the judiciary into areas where it does not belong and the political bias that is clear in too many of the resulting decisions have exceeded any reasonable bound or balance. We call upon Members of Knesset of all parties, those who care about the future and security of the State, to bring about an urgent and imperative reassessment of the functioning and make-up of the judiciary.
